TERMS AND CONDITIONS

Subject to terms and conditions set forth in this, doors manufactured by Botany Bay Timber Products Pty Ltd (in this referred to as "the Company") are guaranteed by the manufacturer for 5 years from shipment date by the Company to be good material and workmanship, free from defects which render them unserviceable or unfit for the use for which they were manufactured.

Products are supplied inaccordance with the normal industry standards of manufacture and Customer's written requirements which the Company has accepted in writing. The Company will not be liable to the customer for qualities of the products which comply with these standards and specifications.

Where any legislation provides for remedies for the Company's breach of a conditionor warranty whether statutory or otherwise, then, at the Company's option, the customer's sole remedy for such breach except a breach of Section 69 of the trade practices act will be limited to such remedy, or the repair of the products; or the payment of the cost of replacing the products; the cost of having the services supplied again. No claim will be accepted unless in writing to the company within seven (7) days of the date of delivery of the products of the supply of services.

Natural variations in the colour and texture of the MDF or wood are not to be considered defects. The utility or structural strength must not be impaired in the fitting of the door, the application of hardware, cutting and altering the door for lights, louvers, panels or any special details. A maximum of 5mm may be trimmed from any door. Normal "show through" of frame components in doors shall not be considered a defect. All entrance, solid and semi-solid core doors must be hinged with 3 x 100mm hinges. ENTRANCE DOORS SHOULD BE HUNG IN WEATHER PROTECTED AREAS. Doors must be given reasonable treatment by the purchaser and should be stored or hung in dry buildings and not in damp, moist or freshly plastered areas where the moisture content of the skins may increase abnormally leading to the development of warp.

Immediately after fitting and before hanging, the entire door including the top and bottom edges, must receive two coats of undercoat and two coats of paint. Sealer must be used and its application to be equivalent to paint finish, to prevent absorption of moisture. Enamel colour must be used on entrance doors, acrylic may be used on internals only. Exterior finishes must be used on Exterior Doors but to be appliedstrictly in accordance with paint manufacturers instructions. Doors exposed to direct sunlight must be finished in light reflective colours to reduce the risk of heat absorption which may cause warping. Dark colours may void warranty. Both faces should have similar colors applied. Regular maintenance should be provided to prevent deterioration.

The Company will not assume responsibility for doors which become defective because of failure to follow these conditions or hazards of transit or storage, after doors leave the control of the Company.

The Company will not beheld responsible for additional charges of hanging, painting or other charges arising from the replacement of doors. Any such defects must be brought to the attention of the manufacturer when discovered and proof of purchase must be presented in any event within five years from the date of transit by the Company. The Company is not liable to reimburse any purchaser for doors repaired without prior written consent of the Company to such repair and replacement.

 

INTERPRETATION OF WARP

Warp shall be interpreted as meaning the cupping/bowing or twisted of doors. It refers to distortion within the door itself and not its relationship to the jambs or frame in which it is hung. Warp exceeding 5mm shall be considered a defect.

 

EXCLUSIONS

The guarantee against warp does not apply to the following:

1. When the cupping is determined by applying a straight - edge to the face of the door, or when twisting is determined by placing the door face against a true plane surface.

2. Any thickness doors wider then 900mm or higher than 2135mm.

3. Doors that arei mproperly hung or do not swing freely.

4. External and Internal Doors which have been improperly sealed, painted dark or different colours on each face.

Experience has demonstrated that when warp occurs after doors have been delivered to storage or building sites, it is usually due to improper storage or adverse moisture conditions after hanging and not faulty manufacturer. The manufacturer will not accept responsibility forthe development of warp when the moisture content of the timber falls bellow 12% or exceeds 18%.

The Company will not accept responsibility for conditions wholly beyond its control. However, the Company should be consulted promptly if excessive warping occurs to provide assistance in overcoming the difficulty.
